The author was drawn to Dick Sizemore-Hall’s mailing it in. The comments also caught my attention. Both comments and the article failed to mention four elephants that Democrats have in the room when it comes to voting rights.
- Federal intervention in the voter education and Assistance Processes
- Voting by the mentally challenged
- The harvesting of ballots is a form of voting.
- Non-citizens voting
When the left examines this list, they see opportunities and not problems.
Joe Biden, the federal government and their storming of the voting system
Executive Order 14019 was issued by President Biden to “assist” voters. The Executive Order 14019 read as follows:
The Federal Government has the responsibility to increase access to and educate about voter information and registration, as well as combat misinformation. This will allow all eligible Americans to take part in our democratic system.
Sec. 3. Expanding access to voter registration and election information The agencies shall explore ways to increase the number of citizens who can register to vote, obtain information on the electoral process, and take part in it.
a) The head for each agency must evaluate the ways that they can promote voter registration, and participation, in accordance with the applicable laws. This effort will include:
(iii). ways to provide voter registration services and applications for vote-by-mail ballots in the course or activities that directly engage the public including:
(A). distribute voter registration forms and ballot applications by mail and provide access to State online systems applicable for individuals who are able to take advantage of these systems.
(B). assist applicants in completing voter’s registration forms and application forms for vote-by mail ballots , in accordance with all applicable State laws.
(C), soliciting and facilitating nonpartisan, third-party organizations to provide voter registration on agency premises.
The public never learned who these approved third-party groups were, or how federal agencies “facilitated” them to “assist voters and applicants”. Or what “assist”, in reality, was.
It’s not surprising that the Heritage Foundation, and the Brennan Center had different views on the executive order. Choose your favorite. Note that the Brennan Center has somehow forgotten to bring up the issue of third-party organizations. This author would be shocked to learn that the Brennan Center is not among them.
Mentally Disabled Voters
The Virginia Constitution states: ” As provided by law, no one adjudicated as mentally incompetent will be eligible to vote until their competency has been restored.” (emphasis in original) Judgements of incapacity are only ordered by Circuit Courts.
Circuit Court Clerks must send a monthly report to the Department of Elections on all people who have been adjudicated mentally incapacitated. In the five-year period from August 1, 2020 to August 31, 2025. The Virginia Department of Elections reported that754 voter registrations were cancelled because they had been adjudicated as mentally incapacitated. VDH informs us that there are 164,000 older adults living with Alzheimer’s Disease.
More than 163,000 Alzheimer’s patients are eligible to vote. How many actually vote? It is statistically significant. Who helps them to vote? Staff at assisted living facilities or nursing homes? Which of Joe Biden’s nonpartisan, approved third-party organizations is yours?
No records contain the answer.
Ballot Harvesting
In Virginia, it is legal to harvest ballots.
Attorney General Miyares stated in an opinion, that “under SS 24.2-707 of the Code of Virginia a mailed-absentee ballot can be returned by a third-party through the mail or a drop off location, upon the voter’s request”.
Anybody can vote.
Long-term care facilities are some of the best places to harvest ballots. The National Conference of State Legislatures provides a list of the 22 states, including Guam, that have implemented supervised voting at long-term care facilities.
Virginia is not one of them.
Voting by non-citizens
Biden’s administration has a major goal in mind when they open the floodgates: illegal immigrants voting. Democrats who want to turn red and purple states blue, applaud the move. Like those in General Assembly.
The Constitution of Virginia Section 1 currently prohibits the voting of non-citizens. Voter qualifications
For elections by the people the following qualifications shall apply: Each voter must be a Citizen in the United States. They must also be at least 18 years old, meet the residency requirements set out in this section and be registered to vote according to this article.
In a moment, we’ll return to the “citizens” term of the Virginia Constitution.
Illegal Voting. The Republican Party of Fairfax County commented on the process to stop non-citizen voters in Virginia.
The official will only discover the noncitizen’s registration when the person identifies themselves as such during a separate government interaction. A noncitizen, for example, registers to vote in a Virginia DMV by checking the box “U.S. citizen” box. He receives a summons for jury service months later because the voter list is used to identify possible jurors. On the court questionnaire he marked “noncitizen”, to avoid serving. The election officials are notified and send him a request to confirm his citizenship.
His registration will be canceled if he fails to reply or admits that he’s not a citizen. If he confirms his citizenship again without requiring proof, he will remain on the list. In either case, a prosecution for perjury would be extremely unlikely. If he does not receive a jury summons, then the system might never find out about the non-citizen registration. The system relies on accidental discovery and voluntary admittance rather than systematic validation.
The author has looked and found no evidence to support the anecdote, or the conclusions drawn. He doesn’t think this practice is common, but it’s troubling that it could happen without an effective way to stop it.
Legal Voting. Legal votes by non-citizens are already taking place in counties all over the country. It is allowed in 16 Maryland jurisdictions. The left strongly endorses.
Will the Virginia Constitution be changed again? Virginia’s Democratic majority will not stop with allowing non-citizens the right to vote at local elections. We will soon see a change in the Virginia Constitution to allow non-citizens to vote. The public will be told that it is a matter for “fairness” during state elections.
Virginia can do this in state elections, because they are held in odd-numbered year to avoid federal elections. Democrats are unlikely to admit that odd-year voting was a legacy from the former Confederate States, who used it to prevent blacks voting in state elections.
The General Assembly floated a “trial balloon”. Each voter who votes in support of the Virginia Constitution amendment to allow partisan gerrymandering this month will be assumed to have voted for the change “from citizen” to “resident .
Next, if Louise Lucas’ amendment to the gerrymander passes, is the proposed change from “resident”. Book it.
Bottom Line
The subject of voting rights is complex. What you can find out with a little bit of research is fascinating. The left-wing and traditionalists are completely opposed to the detail of voting rights provided here and in the “Mail it in” booklet.
This article aims to provide a complete record of these differences.
