Insanity defenses are used in less than 1% of criminal cases and only 25% of the time. Insanity is a defense that is employed in less than 1% criminal cases, and successful in only 25% of the times. In most cases, defendants must prove by clear and convincing proof that they could not distinguish between right and wrong at the time of committing the crime due to a severe mental defect or disease. Insanity can’t be established by alone. The defendant is responsible for proving insanity.
Steve Descano, the Commonwealth’s attorney for Fairfax County (D), has accepted 11 killers’ pleas of “Not Guilty Due to Insanity” and let them avoid conviction. That’s a little over a fifth out of all of the recent killers arrested in Fairfax County. In Fairfax County, killers have a 100-fold higher chance of avoiding conviction if they claim to be insane than in other parts of the country. There is no reason for insanity to be more prevalent in Fairfax County, let alone 100 times more frequent.

10 other killers escaped conviction after Steve Descano’s office accepted the pleas “Not Guilty Due to Insanity”. In the last three years, Descano’s Office has disposed of 50 cases for first and second degree murder. Descano’s office is letting many of Fairfax County’s murderers escape convictions by relying on insanity defences.
After their insanity is accepted, killers can kill again. Peter Bryan, who was a cannibalistic murderer treated in a mental facility, murdered after his release. Javed Bhutto, a D.C. resident, was murdered in 2019 in D.C. by a neighbor that had been found not guilty of murder in 1998 due to insanity. Mark Peterson spent time in a Connecticut mental hospital after an 1980s murder. In 1989, after being released from a mental facility on a one-day pass, he killed Jessica Short, age 9, by stabbing her over 34 times.
Descano is a progressive Democrat who was elected Fairfax County Commonwealth’s attorney after spending almost a million dollars in a very tight primary election. The majority ($601,369) of Descano’s campaign funds came from the Justice and Public Safety PAC. The PAC’s sole donor is George Soros, a liberal billionaire who supports progressive causes, Jason Johnson noted in The Fairfax Times.
Fairfax County has over one million residents, making it the most populous county in Virginia. Nine of the 10 seats in Fairfax County Board of Supervisors are held by Democrats.
