Rapists, child sex offenders, repeat offenders and fugitives are among those who have been released from ICE detentions.

A FOIA requests revealed that since February 2025, the sanctuary jurisdiction Fairfax County has released 205 illegal alien criminals on the streets. Immigration and Customs Enforcement was only notified of 7 criminals arrested. Among the violent criminals released on the streets, rather than being taken into ICE’s custody, were an accused child rapist and child sexual predators. Also included in this group was a fugitive from justice.
Democrats’ sanctuary policy protects violent illegal aliens, at the expense of American safety–including that of children.
The following is a list of charges filed against illegal aliens who have been released on the streets of Fairfax, Virginia since February.
- DUI and vehicular manslaughter
- Ten charges relating to child sexual crimes include:
- Rape of an under-13 victim
- Sexual battery on a child younger than 13
- Sexual battery on two victims under 13 years of age and forced intercourse with a victim under 13.
- Procuring minors for prostitution, porn, sodomy
- DUI with a passenger under the age of 18 (blood alcohol level >.20).
- First-time DUI offenders: 19 charges
- Five second-time DUIs and one third-time DUI
- Twelve charges of strangulation
- 49 charges of burglary or larceny
- One stabbing, 13 assaults and one attack on a police officer
We also found that over 30 criminal aliens who were charged with crimes but failed to appear in court for their crimes.
If you live in Northern Virginia, these monsters may be your neighbors. But Fairfax Sheriff Stacey Kincaid doesn’t seem to want you to learn their names.
Kincaid’s office redacted names of criminals from documents provided to Restoration News, even though other Virginia Sheriffs provide this information on request.
Fairfax County is a sanctuary that shields criminals from being deported, even when ICE issues a detainer.
A spokesperson from Kincaid told Restoration News that they would only hold a prisoner for ICE if there was a “judicial order authorizing the holding of a person.”
Harboring violent criminals
The Fairfax Board of Supervisors passed a “Trust Policy“, in 2021, that allows illegal aliens to be housed even if they have committed violent crimes. The policy stipulates that an administrative warrant must be obtained before local law enforcement can cooperate with ICE. This policy also prohibits the use of county funds in the investigation or enforcement of immigration violations.
The policy refers illegal immigration issues to “civil” rather than criminal violations; however, 8 U.S.C. The federal criminal code, section 1325, declares that illegal entry and failure to leave is a criminal offense, not a civil one.
In an opinion from June, the Justice Department clarified that section 275 (of the Immigration and Nationality act) considers illegal entry into the United States a crime. In February, Glenn Youngkin ordered that state corrections and law enforcement officers fully cooperate with ICE. His only weapon against local jurisdictions, unfortunately, is withholding funding. However, the Democrat-controlled parliament has so far blocked that even from happening.
Lieutenant Governor Winsome-Sears is a naturalized American and legal immigrant. stated: “We have seen far too many tragic tales after dangerous criminals who were in the country illegally, were sent back on to the streets. This Executive Order will ensure that we send them back where they came.”
Sanctuary counties and cities such as Fairfax create a dangerous environment for not only themselves, but also for the whole Commonwealth. Will voters awaken to the dangers leftist policies before they elect leaders in November that will fight radicals such as those in Fairfax.
