Virginia Democrats, inspired by the wave of misleading abortion-until birth ballot measures in other red states sparked the House of Delegates session 2025 in Virginia by voting for an amendment to enshrine the right to abortion up until birth in state constitution.
In the election of 2024, the blue party just barely retained control of the state House. This narrow majority hasn’t prevented them from attempting to push their extreme abortion agenda through the state legislature soon after it convened.
The same Democrats that killed protections for babies born alive after botched abortions recently voted in favor of an unlimited abortion amendment.
To get Virginians to vote, the proposed constitutional amendment must first pass the Senate. Then it will need to be reapproved by both the Senate and the General Assembly following the next election in November. The Democrats’ decision on Tuesday to support the amendment shows their willingness to sacrifice the feelings of voters about abortion for the radicalism in abortion that has plagued Virginia for years.
Virginia’s abortion laws are among the most liberal in the U.S. Virginia’s ban on killing a baby in the womb after 27 weeks gestation without authorization from three doctors does not sit well with a majority who do not support butchering babies past 15 weeks of pregnancy.
The amendment passed on Tuesday goes further than the current laws by asserting that a woman’s “right to reproductive liberty” and her pregnancy decision-making “shall never be denied, burdened or infringed unless justified by an overwhelming state interest and achieved using the least restrictive methods.”

The amendment is supported by advocates who claim it won’t stop Virginia from passing certain parameters regarding late-term abortions. The text of the amendment, however, contains vague language and undefined words that could be interpreted to strip Virginia’s safeguards for women.
The amendment, which protects “individual rights to reproductive freedom” and Virginia Law mandates parents before a minor may obtain an abortion is also threatening.
The amendment prohibits Virginia from “penalizing, prosecuting, or taking adverse action” on anyone who obtains or performs an abortion, regardless of the point in pregnancy, except when justified by compelling state interests.
Democrats are not satisfied with Virginia’s abortion laws, which allow abortion up to the sixth month. The Democrats’ willingness to go against the legislative protocol and make abortions in the third trimester one of the very first votes of 2025 is a sign of how extreme they have become. These actions remind us of the importance of Virginia’s legislative elections this year. GOP candidates need to expose their opponents radical agenda, which includes all-trimester abortioms, parental rights being eliminated and taxpayer funded abortion.
