Fairfax County Public Schools Plans to Spend Tax Dollars to Defend Its Discrimination Against Girls

The United States Department of Education’s Office for Civil Rights concluded its five-month investigation on July 25 into the transgender policy of Fairfax County Public Schools and four other Northern Virginia schools districts (Alexandria Arlington Loudoun Prince William). The United States Department of Education’s Office for Civil Rights (Office for Civil Rights) announced on July 25 that it had concluded a five-month investigation into the transgender policies of Fairfax County Public Schools (Fairfax County Public Schools) and four other Northern Virginia school districts, including Alexandria, Arlington and Loudoun. Office for Civil Rights warned that school districts could face “imminent action” if they did not agree to rescind policies that allowed students to enter intimate spaces based on “gender identities” instead of biological sex.

The Acting Assistant Secretary for Civil Rights of Office for Civil Rights announced the decision and stated that it was time to put an end to Northern Virginia’s experiment in “radical gender ideologies and unlawful discrimination” within schools. He also stated that the “Trump Administration will not sacrifice America’s girls and women on the altar of antiscientific illiberalism.”

The result of the investigation was always clear, as Fairfax County Public Schools has openly and proudly ignored federal and Virginia antidiscrimination laws for a long time. See ” Fairfax Board of Education Defies Virginia Transgender Policy,”Aug. 16, 2023. Fairfax County Public Schools, in defiance of basic biology, has defined gender as a socially constructed system. Fairfax County Public Schools allows students who claim transgender identity to use any locker room or restroom they choose. The only option for accommodation cannot be a single-use or private facility. The biological male has the right to shower and undress in the girls’ locker rooms. If some or all of the girls prefer privacy, they must find other accommodations. In a class of twenty girls with one biological boy, he has the right to shower and undress in the girls’ locker room. If the girls want privacy, they must find alternative accommodations. Fairfax County Public Schools’s policies on transgender are also the most extreme in the nation. See ” Trans Rules Fairfax Schools“, Sept. 7, 2022.

The Fairfax County Public Schools leadership claims that this plan provides a “safe, supportive, welcoming and inclusive environment” for all students. But it does not. The environment for a girl who holds back her urine because she is afraid of being confronted by boys in the restroom does not feel safe, supportive, welcoming, or inclusive. Fairfax County Public Schools’ “inclusiveness”, however, is based solely on the wishes of a small minority and ignores everyone else’s dignity, safety and innocence.

Transgender bullies are causing policy makers to realize that common sense, biology and fairness has been thrown out of whack. Legislative bodies, universities, the NCAA and Olympic organizations are all rescinding their policies which did not protect women and girls’ rights.

But not Fairfax County Public Schools. But not Fairfax County Public Schools.

So, what’s next? The Department of Justice is almost certain to pursue enforcement actions. The federal funding could be cut, affecting important educational needs. Fairfax County Public Schools will hire expensive lawyers. The lower courts may or may not grant relief to school systems. The appeals process will apply to interim and final court decisions. It is possible that the process could take up to two years. The process could cost several million dollars. This process is a distraction to the educational issues Fairfax County Public Schools should focus on.

Prudent leaders will take a step away and re-evaluate the situation, before it becomes a problem of its own. Fairfax County Public Schools leadership seems to be more concerned with ideology than fiscal responsibility and common sense.
